The petitioner apprehends his arrest in connection with Complaint Case No. 4089'C'/2018 registered for the offense punishable under Sections 498-A & 323 of the Indian Penal Code read with Section 3&4 of the Dowry Prohibition Act.

Pursuant to the order dated 22.05.2019, notice had been issued to O.P. No. 2 who has refused to accept notice. In the present case, this Court after hearing the matter had extended interim protection to the petitioner who has appeared in person in Chambers today. He

Patna High Court CR. MISC. No.31384 of 2019(4) dt.03-07-2019 2/2 submits that the opposite party No. 2 had herself deserted him and he undertakes to appear in the Court below as and when required and, therefore, the interim protection may be extended further.

Having considered the gamut of circumstances and also the materials which have been placed before this Court and also because the opposite party has refused to appear in this Court as directed earlier, the order dated 22.05.2019 stands confirmed, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No. 4089'C'/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
