The petitioner is languishing in custody since 12.01.2015 in a case registered for the offences punishable under Sections 20/22 of the NDPS Act.

15 kgs. Ganja was recovered from coaccused Sudhir Kumar, who disclosed the name of the petitioner as his associate.

It is submitted by learned counsel for the petitioner that admittedly the recovery has not been made from the petitioner and Sudhir Kumar, from whom the recovery has been made, has been vide Cr. Misc. No. 23181 of 2012. Considering the aforesaid facts, let the above

Patna High Court Cr.Misc. No.12951 of 2015 (02) dt.01-04-2015 2/2 named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII - cum- Special Judge, NDPS, Patna in connection with Special Case No. 21 of 2011 arising out of G.R.P. (Patna) P.S. Case No. 211 of 2011.

Since the petitioner has surrendered on 12.01.2015 in a case of 2011 and petitioner was accused in one other case of similar nature from before, the learned court below will positively cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
