JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 419, 420, 467, 468 of the Indian Penal Code.
As per the prosecution case, on secret information that petitioner was cheating people a raid was conducted and from his possession, three mobiles, one I Pad Tab and 18 pages of order sheets bearing names and addresses of customers were recovered.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner. The three mobiles seized from the possession of the petitioner belong to his family
Patna High Court CR. MISC. No.43715 of 2021(2) dt.01-11-2021 2/2 members and no any evidence of transaction or cheating was found in the mobiles of I Pad seized from the petitioner's house. Petitioner claims clean antecedent and is in custody since 08.05.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Nalanda at Biharsharif in connection with Manpur PS case No. 63/2021.
