The Petitioner seeks revision of the Judgment in Appeal passed by the Additional Sessions Judge-3rd, West Champaran at Bettiah, in Criminal Appeal No. 39 of 2013 arising out of Shikarpur P.S. Case No. 52 of 2005 by which the Petitioner has been convicted under the Provisions of Arms Act and sentenced to the period of three years imprisonment and 2,000/- and 1,000/- fine.
It has been submitted on behalf of the Petitioner that the Arms were recovered from his house and he has no Criminal antecedent. Also the Petitioner has remained in custody for about eleven months.
Having considered the impugned Judgment, I do not
Patna High Court CR. REV. No.258 of 2015 (2) dt.07-05-2015 2/2 find any perversity in the same and, hence, the application is dismissed.
However, the period of sentence of Petitioner is reduced to one already undergone by him. He shall however be required to deposit fine of Rs.2,000/- and 1,000/- respectively or undergo sentence in default of deposit as directed by the Court below.
