According to prosecution case, the petitioner was neither caught at the spot nor anything was recovered from his conscious possession and the name of the petitioner was disclosed by co-accused from whose house, the alleged recovery was made.

So far as criminal antecedent of the petitioner is concerned; it has been mentioned at paragraph-3 to the petition that only two cases had been registered against the petitioner.

Considering the above-said facts and circumstances as well as submission of the parties, let the petitioner named-above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kargahar P.S. Case No. 50 of 2008 to the satisfaction of Chief Judicial Magistrate, Rohtas, Sasaram.
