JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2020 The office has pointed out several defects to which learned counsel of the petitioner assures that he shall remove the defects within four weeks from the date when the court starts physical function.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 08.06.2020 in a case registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code and 25(1-b) a/26/35 of the Arms Act.

Petitioner was caught with the other accused while they were going on a motorcycle. The informant claimed that motorcycle was stolen property. Petitioner does not have any

Patna High Court CR. MISC. No.32032 of 2020(2) dt.09-12-2020 2/2 criminal antecedent and moreover, no firearm was recovered from his conscious possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on provisional bail till removal of the defects on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Raghopur P.S.Case No. 121 of 2020 It is made clear that if the defects, as pointed out by the office are removed within the above stated period , the provisional bail of the petitioners shall be deemed to be confirmed.
