The petitioner seeks bail in anticipation of his arrest in connection with Barhara P.S. Case No. 120 of 2019 dated 12.06.2019 instituted for the offence under Section 394 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that he has not been named in the FIR nor any suspicion has been raised against him. His complicity in this case has been gathered only on the basis of confession of an arrested accused person. There has not been recovery of any incriminating article from the possession of the petitioner.

In the other case in which the petitioner was

Patna High Court CR. MISC. No.33650 of 2020(3) dt.22-03-2021 2/2 made accused in the past, he has been acquitted. Considering the aforenoted statements, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate (Incharge), Purnea in connection with Barhara P.S. Case No. 120 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
