JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2019 This application, for grant of anticipatory bail, arises out of Agamkuan P.S. Case No. 489/18, disclosing offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms.
Allegation against petitioner no. 1 is of assaulting on the chest of informant by means of bhala and allegation against petitioner no. 2 is of firing, which did not hit anybody. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case in the background of land dispute. Further submission is that there is case and counter case between the parties and the title suit is pending.

Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Patna City, in connection with Agamkuan P.S. Case No. 489/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
