This application for regular bail in General Registration No. 665 of 2020, arising out of Kasma P.S. Case No. 59 of 2020, disclosing offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The petitioners are in custody since 03.08.2020. Allegedly, three motorcycles were intercepted by the police. As per the case of the prosecution, 20 litres of Mahua wine was recovered from the motorcycle of petitioner no. 1, whereas 40 litres of Mahua wine was recovered from the motorcycle being driven by petitioner no. 2 and co-accused Manish Kumar. It has been stated in paragraph 3 of the application

Patna High Court CR. MISC. No.35722 of 2020(2) dt.20-01-2021 2/2 that the petitioners have no criminal antecedent. Considering the aforesaid circumstance and the fact that the petitioners are in custody since 03.08.2020, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-VII cum Special Judge Excise, Aurangabad, in General Registration No. 665 of 2020, arising out of Kasma P.S.
