2. Petitioner seeks bail in a case registered for the offences punishable under Sections 447, 504, 506, 387/34 of the Indian Penal Code and section 27 of the Arm Act.

3. The allegation in the FIR is that five bullets were fired near the house of the informant and one person was hurling abuse and threatening the informant to withdraw the case. The informant has taken the name of five accused persons including the present petitioner as he had also been an accused in the FIR No. 61 of 2023 lodged for kidnapping of his minor grand daughter.

4. Learned counsel for the petitioner submits that the petitioner has been made accused in this case as he was also an accused in the earlier case filed for the kidnapping of the grand

As a matter of fact, the grand daughter of the informant was having love affair with one Chandan Thakur along with whom she had eloped however, subsequently, she was recovered and her statement was recorded under section 164 of the Cr.P.C and the petitioner was also granted anticipatory bail in the said case. It is further submitted that no one has sustained any injury in the alleged firing and even in the FIR, it has not been specifically stated that the petitioner was resorting to firing. No incriminating material was recovered from the possession or from the house of the petitioner and the petitioner has clean antecedent barring the earlier case filed for kidnapping of the grand daughter of the informant being Sakra P.S.Case No. 61 of 2023. Further, the petitioner is in custody since 18.02.2025 and similarly situated co-accused Abhishek Gupta has already been granted bail vide order dated 19.05.2025, passed in Cr. Misc. 32230 of 2025.

5. The learned APP for the State opposes the grant of bail.

6. Taking into consideration the fact that some of the accused persons have already been granted bail and also considering that the petitioner has clean antecedent, let, the above named petitioner, be released on bail on furnishing bail

Patna High Court CR. MISC. No.33264 of 2025(4) dt.18-07-2025 3/3 bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Sakra P.S.Case No. 75 of 2023.
