2. The petitioner has prayed for bail in connection with P.T.N. (Special Case No.) 149 of 2025 arising out of Bahadurpur P.S. Case No. 20 of 2015 registered for the offence punishable under Section 21(c) of the NDPS Act.
3. The case of the prosecution is that three persons on a bike were intercepted. They were apprehended and identified as Nikhil Raj, Johnson Kumar and Rohit Kumar and from the person who was sitting in the middle of the bike, 82 bottles each of 100 ml of ONEREX Cough Syrup were recovered.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.32607 of 2025(2) dt.21-05-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the petitioner is not named in the FIR. During course of investigation, one Nikhil Kumar has named this petitioner in his confessional statement. Nothing has been recovered from the possession of this petitioner. He further submits that Nikhil Raj in whose confessional statement, the name of this petitioner has surfaced, has been granted bail by the Co-ordinate Bench of this Court vide order dated 16.05.2025 passed in Cr. Misc. No. 30278 of 2025. The case of this petitioner stands on better footing. Petitioner is languishing in judicial custody since 12.03.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of five cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (NDPS Act), Darbhanga in
