JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-10-2020 The present writ petition has been filed for setting aside the order dated 15.06.2020 passed by the Sub-Divisional Officer, Tekari, Gaya, whereby and whereunder the P.D.S. licence of the petitioner has been terminated. At the outset, the learned counsel for the State Shri Alok Ranjan has raised a preliminary objection regarding maintainability of the present writ petition inasmuch as the petitioner has got an alternative and efficacious remedy of appeal against the impugned order dated 15.06.2020. In such view of the matter, the learned counsel for the petitioner has sought to withdraw the present writ petition

Patna High Court CWJC No.8378 of 2020(2) dt.21-10-2020 2/2 with liberty to the petitioner to file an appeal against the impugned order dated 15.06.2020, however, it is submitted that the appellate authority be directed to dispose of the appeal within a stipulated time frame.

Accordingly, the present writ petition stands disposed of as withdrawn, however, with liberty to the petitioner to file appropriate appeal against the order dated 15.06.2020 and in case such an appeal is filed within four weeks from today, the appellate authority shall be obliged to dispose of the same within a period of three months thereafter.
