Petitioners and three others are named in the first information report and there is allegation that they assaulted the deceased with lathi and danta.

Originally, FIR was lodged under sections 341, 323, 324, 379, 504/34 of the IPC but after death of the informant section 302 of the IPC was added.

Learned counsel for the petitioners drew my attention towards para 13 of the petition and submitted that in course of post mortem examination, only one injury was found on the person of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above stated petitioners be released

Patna High Court Cr.Misc. No.5639 of 2015 (2) dt.11-02-2015 on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in Gopalpur P.S. Case no. 81/2014.
