Through this writ application, the petitioner seeks following reliefs:- (i) for restrain the respondents authority to construct the New Panchayat Sarkar Bhawan in Village Kumhrar situated at Rupolia Khani Panchayat at the place of Rupolia Khani village, the head quarter village of the said Rupolia Khani Panchayat, and sufficient government land is available in the same village and Rupolia Khani

Patna High Court CWJC No.7944 of 2024(2) dt.16-07-2024 2/3 village fulfill all criteria, as per Government guideline. For construction of Panchayat Sarkar Bhawan. But the Block Development Officer, Phenhara in connivance with present Mukhia of the said Rupolia Khani Panchayat decided to construction of Panchayat Sarkar Bhawan at village Kumhrar. This action is totally contrary to the Government guideline.

(ii) issue for direction to respondent to modify/change the construction place in the technical bid (if any) and include the name of village Rupolia Khani village at the place of Village- Kumhrar and after consider the application/objection of the villagers of Rupolia Khani village, construct the New Panchayat Sarkar Bhawan in Rupolia Khani village. In the light of Government guideline as well as policy of Bihar Government for the same.

(iii) for issue direction to the respondent, not to proceed for construction of New

3. After some argument, learned counsel for the petitioner submits that he will be preferring a petition before the respondent no.2 (the District Magistrate, East Champaran, Motihari).

4. Granting said liberty, the writ petition stands disposed of.
