JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 Petitioner apprehends his arrest in connection with Rajnagar P.S. Case No. 235 of 2016, G.R.No. 2263 of 2016, registered for the offences punishable under Sections 341, 323, 324, 379, 498A, 34 of the Indian Penal Code and Sections 3, 4 of Dowry Prohibition Act.
Allegation is of demand of dowry and subjecting the wife of petitioner to cruelty.
Submission of learned counsel for the petitioner is that the main allegation is against father-in-law of the victim lady and he has falsely been implicated in this case and further father of petitioner has already filed an inflammatory petition and lodged a complaint against the informant and petitioner is still ready to keep her with him.

No.1619 of 2019(2) dt.24-01-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Madhubani, in connection with Rajnagar P.S. Case No. 235 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that if maintenance case is filed by the informant the petitioner has to co-operate in disposal of the same, otherwise the informant is at liberty to move for cancellation of bail bond of the petitioner before the court below itself.
