JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Begusarai Town P.S. Case No. 45 of 2018, disclosing offences under Sections 467, 468, 420 of the Indian Penal Code.

Allegation against the petitioner is of getting himself illegally appointed as Non Medical Assistant Leprosy Control Unit, Begusarai.

Submission of learned counsel for the petitioner is that the petitioner has appointed in the year 1987 and after 30 years the present case has been lodged against the petitioner and no enquiry report is available and considering the same one coaccused person has been granted privilege of anticipatory bail by this Court vide order dated 23.08.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.1406 of 2019(2) dt.22-01-2019 2/2 No. 48177 of 2018. Further, the petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 45 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that he will cooperate in investigation of the case and will appear as and when required by the police, otherwise his bail bonds shall be cancelled.
