Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case for the offence registered under Sections 364, 364(A), 366 and 498 of the Indian Penal Code.

Prosecution case in short is that wife of the petitioner was kidnapped.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-05-2020. Charge

Patna High Court CR. MISC. No.34702 of 2020(2) dt.19-01-2021 2/2 sheet/Prosecution report in this case has already been submitted. The petitioner has been falsely implicated in the present case. The wife of the petitioner is said to have taken away by in laws of the petitioner. A case vide Annexure-2 has also been instituted by the petitioner. There was some dispute between the victim and the petitioner. The petitioner has remained in custody for more than 10 months.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 118 of 2019.
