JUSTICE PRABHAT KUMAR JHA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner, learned APP as well as learned counsel for the informant.

The petitioner seeks bail in Muffasil P.S. Case No. 73 of 2014, registered for the offences punishable under Sections 376/511 and other Sections of the Indian Penal Code. The prosecutrix made allegation that the petitioner entered into her house after jumping over the boundary wall and made an abortive attempt to commit rape with the victim/prosecutrix, but due to protest made by the prosecutrix the petitioner could not succeed in his attempt.

Learned counsel for the petitioner submits that the petitioner is in jail since 16.07.2014.

On the other hand, learned counsel for the informant has

Considering the facts and nature of allegations made against the petitioner and the fact that the petitioner has already remained in jail for more than eight months, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 73 of 2014.
