JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 The petitioner apprehends his arrest in connection with Bahadurpur P.S.Case No. 259 of 2018 registered under Sections 201 and 302 of the Indian penal Code.

Allegation against the petitioner, who happens to be husband of the deceased is that he killed the deceased. Submission of learned counsel for the petitioner is that FIR itself shows that door was closed from inside the room and dead body was found hanging in the room. He further submits that during investigation witnesses have also stated that door was closed from inside and deceased was found hanging and son of the petitioner as well as deceased has also stated that petitioner was not at home at that time and death was caused due to hanging.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Bahadurpur P.S. Case No. 259 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
