2. The petitioner apprehends his arrest in connection with Nayagaon P.S. Case No. 27 of 2023 registered for the offences punishable under Sections 341, 323, 324, 307, 504, 379/34 of the Indian Penal Code.
3. As per prosecution case, on the date of occurrence when the informant was filling soil at his door then the petitioner along with other accused persons came to the house of the informant and tried to stop the informant, when the informant objected then the petitioner and co-accused Doman Yadav ordered to assault, then all the accused persons assaulted the informant and his family members causing injury to them. The accused persons also snatched gold chain and earring from the daughter-in-law of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is case and counter case between the parties. Petitioner and informant are agnates. Petitioner is an old person aged about 74 years having no criminal antecedent. Petitioner undertakes to cooperate in the investigation and trial of this case.
5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Nayagaon P.S. Case No. 27 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
