JUSTICE SHIVAJI PANDEY ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner and the State. In this case allegation against the petitioner has been made to have perpetuated sexual assault on a 7-year girl, as such, he does not deserve sympathy. Accordingly, this petition is dismissed.
The report received from the 1st Addl. Sessions Judge, Bhagalpur shows that he has taken all efforts for securing the attendance of witnesses but utterly failed on account of nonco-operation extended by the prosecution side. The Senior Superintendent of Police, Bhagalpur is directed to look into the matter and ensure that all witnesses, including the official witnesses are examined within six months from the date of receipt/production of copy of this order.
