The petitioner seeks bail in Kishanganj P.S. Case No. 47 of 2019 arising out of Special Case No. 3 of 2019, instituted for the offence under Section(s) 27 and 29 of N.D.P.S. Act.

It is alleged in the written report that Police, on confidential information that some boys who used to sell smack near bus are standing under over-bridge of the bus Stand, reached there and apprehended this petitioner on chase. It is further alleged that 1 gm 400 milli gm. smack is alleged to have been recovered from possession of the petitioner. Counsel for the petitioner submits that recovered smack is small quantity. He further submits that petitioner is in

Patna High Court CR. MISC. No.30950 of 2019(2) dt.29-05-2019 2/2 custody since 28.1.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge (N.D.P.S) Act, Kishanganj, in connection with Kishanganj P.S.
