2. The petitioner makes a prayer for bail in connection with Kinjar P.S Case No. 165 of 2023 registered for offences under Section 395 of the Indian Penal Code.
3. The allegation in the First Information Report is that the paddy laden truck of the informant was overtaken by a bolero car and some unknown miscreants forced the informant and his driver into their bolero car to a lonely place where they were dropped by the miscreants. It is alleged that the paddy which was loaded on the truck was stolen away.
4. Learned counsel for the petitioner submits that the First Information Report was lodged against unknown miscreants and the name of the petitioner transpired during
Patna High Court CR. MISC. No.32235 of 2025(2) dt.19-05-2025 2/3 course of the investigation upon the confessional statement of another co-accused Shambhu Kumar. It is stated that the said accused Shambhu Kumar has already been granted bail vide order dated 19.08.2024 passed in Cr. Misc. No. 28986 of 2024 and it has been taken note in the said order that 12 bags of paddy out of 682 bags loaded on the truck were recovered from the go-down of the said Shambhu Kumar. On such grounds another co-accused namely, Vinay Manjhi has also been granted bail vide order dated 16.12.2024 passed in Cr. Misc. No. 44208 of 2024. The petitioner is in custody since 16.02.2025.
5. Learned APP for the State however, opposes the grant of bail on the ground that the petitioner has criminal antecedent however, it has been submitted on behalf of the petitioner that the petitioner is on bail in all the other cases.

Considering the period of custody and that charges have already been framed, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned S.D.J.M. Arwal, in connection with Kinjar P.S Case No. 165 of 2023 and subject to the further condition that:- (i) One of the bailor should be a family member or a

(ii) the petitioner shall co-operate in the investigation/trial.
