The petitioner seeks bail in connection with Ballia P.S. Case No. 79 of 2020 dated 13.03.2020 instituted for the offence under Sections 25(1-B), A, 26 of the Arms Act.

One country made pistol without any cartridge is said to have been recovered from beneath the bed from the house of the petitioner.

Learned counsel for the petitioner submits that the same has been planted in the house of the petitioner for falsely implicating him in this case.

The petitioner is in custody since 30.05.2020 and earlier to this case, he was made accused only in

Patna High Court CR. MISC. No.33435 of 2020(2) dt.15-12-2020 2/2 one case at the instance of his brother in which he is on bail.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 79 of 2020.
