The petitioner seeks bail in Town P.S. Case No. 295/2014, registered for the offences punishable under Sections 366(A) of the Indian Penal Code.

The father of the victim alleged that his daughter was kidnapped on 01.09.2014 by the petitioner. It is submitted that the occurrence is of 1.09.2014 but the FIR was lodged on 20.09.2014. The victim appeared and she made her statement under Section

Patna High Court Cr.Misc. No.10455 of 2015 (2) dt.17-03-2015 2/2 164 Cr.P.C. and disclosed that she was intoxicated and petitioner took her to Rajasthan. The Doctor found the age of the victim between 19-20 Years. It is submitted that from contents of the F.I.R. as well as the statement of the victim, it would appear that victim is a major and left her house voluntarily and went alongwith the petitioner. Victim returned her house and made her statement in presence of her mother. It appears from her statement that victim is consenting party and she went alongwith petitioner to different place. Petitioner is in jail since 17.12.2015. Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Aurangabad in connection with Town P.S.
