JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sarai P.S. Case No. 69 of 2018 for the offenses under Section 394 of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioner is that he was involved in bank loot in Bandhan Bank, Sarai. Learned counsel for the petitioner submits that the name of the petitioner surfaced in this case on the confessional statement of co-accused Abhijit Kumar. The petitioner is in custody since 2.11.2018. Co-accused Vikash Kumar has been granted bail by a Co-ordinate Bench of this Court on 12.4.2019 in Cr. Misc. No. 20404 of 2019.

Considering the fact that the petitioner has remained

Patna High Court CR. MISC. No.42770 of 2019(2) dt.10-07-2019 2/2 in custody since 2.11.2018 and co-accused has been granted bail, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 69 of 2018.
