02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 89 of 2010, registered for the offence under Sections 384, 352, 380, 323 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on the alleged date and time of the occurrence, 7-8 unknown criminals came and asked for paying Rupees Three Lacs, as extortion. It is further alleged that the aforesaid criminals forcibly took out cash of Rs. 22,000/- from the Godrej, cash of Rs. 875/- from the pocket of informant and took away mobile phones and other articles. Petitioner is not named in the FIR. Name of the petitioner has come on the basis of confessional statement of coaccused Santosh Kumar, who has already been granted bail by

Patna High Court CR. MISC. No.44065 of 2021(3) dt.02-11-2021 2/2 this Court, vide order dated 10.04.2015 passed in Cr.Misc. No. 13909 of 2015 (Annexure P/2). No incriminating article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.Parade. Petitioner is in custody since 16.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Barh, District - Patna in connection with Bakhtiyarpur P.S. Case No. 89 of 2010.
