Petitioner seeks bail in Excise (Complaint) Case No.66 of 2020-21 corresponding to Excise Act Case No.406 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The Excise Officials raided the house of the petitioner after information that the petitioner and Babul Kumar Yadav were selling illegal liquor in their village and on search, 68.250 litres of foreign liquor of different brands was recovered from the hut of the petitioner.

Learned counsel for the petitioner submits that the hut was of joint family. Nobody has seen the petitioner keeping liquor in that hut. The petitioner is in jail since 23.06.2020. The

Taking into consideration the facts that the petitioner has already remained in jail for more than six months for recovery of 68.250 litres of foreign liquor of different brands, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise Act, Madhepura in connection with Excise Act Case No.406 of 2020 arising out of Excise (Complaint) Case No.66 of 2020-21.
