The petitioners apprehend their arrest in Laukahi P.S. Case No.156 of 2018 registered under Sections 307, 379 and other minor sections of the Indian Penal Code. The informant alleged that the petitioners and others assaulted him with different weapons and also took out Rs.500/- from his pocket. When the sister and others came to save, the accused persons also assaulted them.
Learned counsel for the petitioners submits that there is a case and counter case being Laukahi P.S. Case No.157 of 2018. The informant got two injuries which are superficial and simple in nature. The allegation of theft is ornamental. Learned counsel for the informant as well as learned
Patna High Court Cr.Misc. No.721 of 2019(2) dt.21-01-2019 2/2 Additional P.P., however, opposed the prayer for anticipatory bail.
Having considered the facts that there is a case and counter case and the injuries sustained by the informant are simple in nature, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No.156 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
