The petitioners are in custody since 19.7.2014 in connection with Jagdishpur P.S. Case No.136 of 2014 registered for the offences under Sections 376, 120B and other sections of the Indian Penal Code.
The allegation against the petitioners is that they had kidnapped the daughter of the informant. However, in the statement made under Section 164 Cr.P.C., the victim girl, namely, Ambika Devi, has clearly stated that she had married to Sheo Shankar Sharma (petitioner no.1) of her own sweet-will and that she had been living with him for the past one year without any
Patna High Court Cr.Misc. No.46682 of 2014 (2) dt.16-02-2015 2/2 coercion. She has further stated that she had left of her own accord and had not been kidnapped.
Considering the aforementioned submissions and the period of custody, let the above named petitioners be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Jagdishpur P.S.
