Mr.Sri Sadanand Paswan ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 08-02-2019 Heard the parties.

The appellant seeks pre-arrest bail in connection with Mahila P.S. Case No.60 of 2018 registered for offences punishable under Sections 376, 506/34 of the Indian Penal Code and Section 3(2)(Va) of SC/ST Act.

Allegation against the appellant is to attempt to commit rape of the informant.

Submission of learned counsel for the appellant is that FIR shows that she has never appeared before the Medical Board for examination and appellant has been falsely implicated in this case.

Learned Special P.P. has opposed the prayer for bail.

Patna High Court CR. APP (SJ) No.22 of 2019 dt.08-02-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail rather than the appellant surrender before the Court below and make a prayer for regular bail which will be considered on its own merit without being prejudiced the order of this Court.
