The petitioner seeks bail in a case registered under sections 20, 22 of the N.D.P.S. Act.

According to the prosecution case police went to the village of Nakhru Rai @ Naresh Rai and found him cultivating cannabis plant. On his disclosure Lalmiki Rai and Bundela Rai were also found cultivating Cannabis plant.

Learned counsel for the petitioner submits that from perusal of the seizure list it would appear that the number of plants of ganja was not mentioned. Petitioner is in jail since 29.08.2014. Petitioner is the son of Bundela Rai and Bundela Rai has also been made accused in this case.

Considering the aforesaid fact, the petitioner has

No.5771 of 2015 (2) dt.11-02-2015 2/2 remained in jail for more than four months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Special Judge, N.D.P.S.
