2. The petitioner is apprehending his arrest in a case in connection with Sahajitpur P.S. Case No. 143 of 2025 dated 18.11.2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 324(4), 303(2), 352, 351(2) and 3(5) of the B.N.S.
3. As per the allegation, due to previous dispute, petitioner and co-accused persons came near the house of the informant and started abusing him. It has further been alleged that all accused persons including the petitioner, armed with knife, lathi and danda started mercilously assaulting the
Patna High Court CR. MISC. No.34319 of 2026(2) dt.18-05-2026 2/3 informant. It has been specifically alleged that co-accused Nitish Kumar @ Makhiya who was armed with knife pierced the abdomen of the informant by the said knife.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner whereas specific allegation of assault by knife has been attributed to co-accused Nitish Kumar @ Makhiya. It has further been submitted that petitioner is working as a driver at Bangalore and he has falsely been implicated with ulterior motive. It has lastly been submitted that petitioner has got no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Saran at Chapra in connection with Sahajitpur P.S. Case No. 143 of 2025, subject to conditions as laid down under section 482(2)

8. The application stands allowed.
