Petitioner apprehends his arrest in Andar P.S. Case No.52 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The police saw four persons unloading some articles from a jeep but seeing the police all the four persons started fleeing away. On chase two persons, namely, Manoj Singh and Ramchandra Gor were apprehended who disclosed that petitioner Mantu Yadav and Pappu Yadav managed to flee away. On search 66.60 litres of country made liquor was recovered. The jeep and one motorcycle were also recovered, which are said to be stolen property. The name of the petitioner was disclosed by the persons apprehended on the spot.

No.30628 of 2019(2) dt.09-05-2019 2/2 Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner but it appears that the petitioner and Pappu Yadav managed to flee away and two persons were apprehended. The petitioner was also accompanying the apprehended accused and carrying liquor on the jeep.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
