The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 341, 323, 324, 379 and 307 of IPC.
Allegation against the petitioner is to have assaulted Umesh Patel, the brother of the informant with farsa. It is submitted that there was a land dispute between both the parties for which an occurrence of assault had taken place. There is injury on both sides. The petitioner has lodged counter case vide Darpa P. S. Case No. 60 of 2014 for the offence punishable under Sections 379 and 307 IPC against the prosecution party of the case. Other accused have been granted
Patna High Court Cr.Misc. No.15210 of 2015 (2) dt.02-06-2015 2/2 bail. The petitioners have been in custody since 15.2.2015 having no criminal antecedent Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned K. Prasad, Judicial Magistrate, 1st Class, Raxaul at Motihari/court concerned in Darpa P. S. Case No. 59 of 2014, G. R. No. 499 of 2014 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
