The petitioner seeks regular bail in a case registered under Section 396 of the Indian Penal Code.

It is submitted that the petitioner was on bail. His bail bonds were cancelled on 18.10.2011 and consequently he was declared absconder on 29.08.2012. The petitioner filed a petition on 22.04.2014 that he was in jail in connection with S. Tr. No. 813/08. The petitioner was remanded in this case on 02.07.2014. It appears that the petitioner has already remained in jail for about eight months for misuse of the privilege of bail for three years.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.5790 of 2015 (2) dt.11-02-2015 2/2 each to the satisfaction of the learned Addl. Sessions Judge II, Lakhisarai in Sessions Case No. 815 of 2008, arising out of Lakhisarai P.S. Case No. 302 of 2004.
