JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-12-2021 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

The petitioners apprehend their arrest in connection with Bakhraj P.S. Case No. 57 of 2018 registered for offence punishable under sections 304(B), 120(B)/34 of the Indian Penal Code.

As per allegation, the marriage of the informant's daughter was solemnized with co-accused, Shiv Pujan Mahto.

Patna High Court CR. MISC. No.10387 of 2021(2) dt.23-12-2021 2/3 Shiv Pujan Mahto subjected the deceased to cruelty, complaining that she was of dark complexion. He threatened the deceased that he will solemnize his second marriage with a girl of white complexion, if the demand of Rs. 1,00,000/- is not fulfilled. He also threatened the deceased to kill. On 01.04.2018, the informant got information that his daughter is not well. When he went to her house, he found that his daughter was done to death. Lastly the informant expressed his doubt that the petitioners and husband Shiv Pujan Mahto have committed murder of the deceased.

Considering the above mentioned facts that the allegation to torture the deceased is only against the husband and not against the petitioners, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned 8th Additional Sessions Judge, Muzaffarpur in connection with Bakhraj P.S. Case No. 57 of 2018, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove,
