The petitioner is languishing in custody since 19.10.2014 in a case registered for the offences punishable under Sections 341, 323, 324, 447, 307 and 379 of the Indian Penal Code.
The accusations are of causing injury on the chest of the informant with knife by the petitioner and taking away mobile and cash Rs. 2,000/- from the pocket of the informant.
It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow. The injury report reflects only one injury. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent and there is counter version of the
Patna High Court Cr.Misc. No.9136 of 2015 (2) dt.13-03-2015 2 / 2 occurrence also.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, UdaKishunganj, Madhepura, in connection with Bihariganj P.S. Case No. 175 of 2014.
