JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Mahnar P.S. Case No. 280 of 2018, disclosing offences under Sections 341, 323, 324, 354, 354(A), 354(B), 307/34 of the Indian Penal Code and Section 8 & 12 of the POCSO Act. Prosecution story is that the petitioner and one more entered the said house of the informant and committed illegal behaviour with her minor daughter, they protested the accused persons. Petitioner assaulted by Farsa on the son the informant causing injury to him Submission of the learned counsel for the petitioner is that a complaint case has also been lodged by the petitioner against the informant and others and petitioner has also received injuries. The whole case is false and fabricated.

Heard learned A.P.P. who opposed the prayer for bail stating that all witnesses have also been supported the prosecution case and the injury was also found on the persons of son of the informant. .

No.30542 of 2019(4) dt.19-07-2019 2/2 Having heard both sides, in view of that facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
