The petitioner apprehends his arrest in connection with Hussainganj (M.H. Nagar) P.S. Case No. 82 of 2018 registered under Sections 120(b), 420, 201, 272, 273 and 308 of the Indian Penal Code and section 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ill motive of the informant. Nothing has been recovered from the possession of this petitioner Further submission is that on perusal of seizure list, it appears that the alleged recovery has been made from the road near the temple. The recovery has been made from the
Patna High Court CR. MISC. No.36704 of 2019(2) dt.25-06-2019 2/2 vehicle and the petitioner has no concern with the alleged vehicle.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional District and Sessions Judge-cum-Special Judge (Excise), Siwan in connection with Hussainganj (M.H. Nagar) P.S. Case No. 82 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
