The petitioner has prayed for regular bail in a case instituted for the offence under Sections 447, 341, 323, 324, 307, 354, 506 and 504/34 of the Indian Penal Code. The allegation against the petitioner along with other is of assaulting the informant, his wife and mother as a result of which they sustained injury.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to old dispute. He has committed no offence. The petitioner and informant are co-villagers and co-sharer and due to previous enmity falsely been implicated in this case. Petitioner was not present at the place of occurrence. He submitted that
Patna High Court CR. MISC. No.34478 of 2023(2) dt.26-06-2023 2/2 prosecution case is not in consonance with the medical report. There is general and omnibus allegation against the petitioner. He further submitted that the others co-accused have already been granted bail by a Co-ordinate Bench vide order dated 03.08.2022 passed in Cr. Misc. No. 9616 of 2022. He is languishing in judicial custody since 17.02.2023. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Rosera, Samastipur in connection with Rosera P.S.
