JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioners and the State. The petitioners being the cousin of the informant are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 427, 379 and 504 of the Indian Penal Code.

It is alleged that the petitioners committed theft in the house of the informant and made assault.

It is submitted by learned counsel for the petitioners that the mother of petitioner nos. 1 to 3 is the own sister of mother of the informant and due to dispute with regard to sharing of the land of the maternal grand-father, the accusation has been levelled. This Court is not inclined to grant anticipatory bail to

Patna High Court Cr.Misc. No.9579 of 2015 (2) dt.11-03-2015 2/2 petitioner nos. 1, 3 and 4 since they have been convicted in another case, but considering the nature of accusation it is a case for consideration of prayer for regular bail. Let the learned court below consider the prayer for regular bail of the petitioner nos. 1, 3 and 4 if they surrender within a period of six weeks.

Considering the nature of accusation, let the above named petitioner no.2 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Basopatti P.S.
