Heard both parties.
The petitioner seeks bail in Birpur P.S. Case No. 91 of 2021, registered for the offence punishable under Section 306/34 of the Indian Penal Code.
As per the prosecution case, daughter of the informant was married with Rajan Raut. It was love marriage. After marriage petitioner and his family members demanded Rs. 5 lakh as dowry from the informant and due to non-fulfillment of demand of dowry the accused persons ousted the girl from her matrimonial home for which panchayati was held, but matter could not be resolved. Daughter of informant lodged case against petitioner and others. Ultimately, on 22.03.2021 the
Patna High Court CR. MISC. No.43195 of 2021(2) dt.29-10-2021 2/2 daughter of informant committed suicide at her Maike. It is submitted on behalf of the petitioner that petitioner is husband of the deceased. There is love marriage between the petitioner and the daughter of informant. Petitioner also filed a case under Section 9 of the Hindu Marriage Act for restitution of conjugal rights before the Court of learned Principal Judge, Family Court, Supaul and when notice was served to the informant then informant lodged this case against petitioner. In fact, the deceased committed suicide at her parental house (Maike). Petitioner is in custody since 23.03.2021 having no criminal antecedent. Chargesheet has already been submitted.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S.
