Mr.Abhay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Sections 8, 20(b)(i)(c), 25 and 29 of The Narcotic Drugs and Psychotropic Substances Bill, 1985. As per prosecution case, 1516.8 kilograms of Ganja was recovered from the truck of which petitioner is a registered owner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that petitioner had already sold the truck in question to one Ganesh Mahto and was not aware of the fact that it was being used for illegal activity. Petitioner has got clean antecedent.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.34213 of 2022(3) dt.10-11-2022 2/2 bail application submitting that petitioner is registered owner of the truck in question.

Considering the fact that huge quantity of illegal substance was recovered from the truck of which this petitioner is a registered owner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
