The petitioner seeks bail in connection with Kathaiya P.S. Case No.74 of 2020 registered under Sections 399, 402 of the Indian Penal Code, Sections 25(1-B)a, 25, 35 of the Arms Act and Sections 8, 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act.

It is submitted by learned counsel for the petitioner that there is no recovery of narcotics or psychotropic substance from the possession of the petitioner. The only material which has been collected against the petitioner is that a country-made loaded pistol was recovered from his possession for which he is in custody since 20.06.2020. It is also contended that the petitioner has got no criminal antecedent and having got roots in

Learned counsel for the State has opposed the application for grant of bail to the petitioner. However, he admits that from possession of the petitioner no incriminating narcotics or psychotropic substance was recovered. He also contends that the allegation against the petitioner is that a country-made loaded pistol was recovered from the possession of the petitioner.

Considering the nature of the allegation and the period of over six months undergone by the petitioner in custody, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, Muzaffarpur in connection with Kathaiya P.S. Case No.74 of 2020.
