The petitioner seeks his bail in a case registered under Section 420 and other sections of the IPC and section 138 of Negotiable Instrument Act.
The informant made allegation that the petitioner took Rs.17,25,000/- for getting him admitted in the D.Y. Patil Medical College but the petitioner did not get admission in the said college. The petitioner returned the said amount through three cheques which were dishonored.
It is submitted that the petitioner is in jail since 16.8.2014.
Learned counsel for the informant, however, vehemently opposed the prayer of the petitioner and submits that the petitioner has cheated the informant and the trial is going on. Considering the facts that the petitioner has remained in jail for more than 10 months, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.47435 of 2014 (4) dt.24-06-2015 2/2 each to the satisfaction of Shri Manish Dwivedi, Judicial Magistrate, Ist Class, Sitamarhi in connection with Sursand P.S.Case No.86 of 2010, subject to condition that both the bailors should be local having substantial immovable property in their names and the petitioner shall appear in the court on each and every date.
