JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 457, 380/34 of the Indian Penal Code.

As per the prosecution case, while the informant had gone to Goa, petitioner and other accused persons committed theft in his house and looted Rs.5,80,000/0 and jewelery. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Petitioner happens to be nephew of the informant and there was some dispute between them. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has claimed clean antecedent and he is in custody since 21.4.2021.
