JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273,290 of the Indian Penal Code and 47-A of the Excise Act.

105 litres country-made liquor are said to have been reovered from house of the petitioner, for which, the petitioner is languishing in jail custody since 13-03-2016. Submission on behalf of petitioner is that the present case was lodged before amendment in Excise Act and moreover, the petitioner appears to be first offender.

Considering the above-said facts and circumstances

Patna High Court Cr.Misc. No.24807 of 2016 (2) dt.20-06-2016 2/2 of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ramgarhwa P.S. Case No. 20 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, Motihari at East Champaran.
