JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 326, 307, 435, 120B & other minor sections of the Indian Penal Code, Section-27 of the Arms Act, Section-17 of CLA Act and Sections-39, 10, 16, 12, 20, 21, 38 of U.A.P. Act. Petitioner is named in the first information report and the informant claims to have seen the petitioner and others, fleeing from the place of occurrence, having fire-arms in their hands. Contention on behalf of petitioner is that co-accused, Ramchandra Yadav and several others having more or less similar allegation, have already been granted privilege of bail by different benches of this court. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Barachatti (Mohanpur) P.S. Case No. 528 of 2013 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati at Gaya.
