The petitioner is languishing in custody since 29.10.2013 in a case registered for the offences punishable under Sections 448, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that two unknown extremists came to the medical clinic of the informant and inquired about the informant and subsequently resorted to two rounds of firing. Though, on injury was caused to anyone. The incident was narrated to the informant by his compounder.

Though, the FIR was lodged against

Patna High Court Cr.Misc. No.16030 of 2015 (02) dt.22-05-2015 2/2 unknown, but subsequently on the information of spy the petitioner has been roped in the present case. Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran in connection with Rajepur P.S. Case No. 47 of 2013. Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of offence or defaults for two consecutive occasions.
